A Fulton County judge heard a motion from Andrea Sneiderman late last week to throw out a wrongful death lawsuit by Steve Sneiderman, her brother-in-law, according to the Atlanta Journal-Constitution.

Steve Sneiderman's attorney argued that his suit should stand.

Russell Sneiderman was killed in the fall of 2010 at Dunwoody day care, that Sandy Springs students attend. In March, Hemy Neuman, Andrea Sneiderman's boss at GE Energy was convicted in the shooting death of Russell Sneiderman.

Andrea Sneiderman was indicted and arrested for malice murder and other charges in connection with her late husband's death. She is scheduled for an arraignment on the criminal charges on Monday.  

Two wrongful death suits have arisen out of the murder of Russell Sneiderman; one by Andrea Sneiderman against Hemy Neuman and one by Steve Sneiderman against Andrea Sneiderman.

The judge didn't make a decision last week on whether to through out the suit by Steve Sneiderman, according to the report.
