Sandy Springs May Use Eminent Domain For Sidewalk Project

Several temporary easements will be acquired for the city's sidewalk improvement project along Roswell Road.

The Sandy Springs City Council on Tuesday will consider utilizing eminent domain to acquire temporary easements on four parcels needed for a sidewalk project. 

The council will consider using the process to acquire temporary easements at 5903 Roswell Road, 5925 Roswell Road and 6196 Roswell Road for the Cliftwood Drive to Hammond Drive sidewalk project. 

The meeting will begin Tuesday night at 6 p.m. at Sandy Springs City Hall.

The city is utilizing eminent domain as the landlords, Roswell Road Associates LLP, have not been able to obtain consent from its tenants, according to the meeting agenda packet.

The businesses that will be affected are Chick-Fil-A, El Azteca restaurant, Boston Market, Lowe's Home Improvement and Master Kleen. 

The project will enhance the sidewalk along Roswell Road between Cliftwood Drive and Hammond Drive. The city entered into a contract with the Georgia Department of Transportation for the project, which calls for the city to be reimbursed in an amount not to exceed $612,120 once the project is complete.
